The Standard agreement is a legal contract between you and Brainline.
In order to enjoy learning with Brainline, you have to read and accept this agreement.

A. GENERAL TERMS AND CONDITIONS

1. Definitions: In this agreement, the following meaning is ascribed to the words below unless the contract implies otherwise.
• “I” and “me” means the client,
• “you” refers to the supplier, being Brainline Holdings (Pty) Ltd (hereafter Brainline),
• “Head Office” means the main administrative centre of Brainline,
• “problem experienced” means any problem that may be encountered,
• “certificate” means a certificate containing the information regarding amounts owed and interest.
2. I accept that reference to the singular in this agreement shall embrace the plural and vice versa unless the contents imply otherwise.
3. I understand that this is a binding offer for the product, subject to acceptance by Head Office. Enrolment by Head Office is confirmed by both academic and financial approval. Should I neglect to receive the product (either as an electronic download, or online), this shall in no way affect my responsibilities and liabilities in terms of this agreement.
4. I agree and accept that my relationship with Brainline (acting in my capacity as an adult, or on behalf of my child/ren), is purely voluntarily. This association does not bind Brainline in any way, other than as stated in this document or on official company websites (brainline.com and/or brainONLINE).
5. I agree that, should Brainline find our relationship has broken down (having exhausted all internal processes for the resolution of conflict), Brainline is free to release me from my relationship with Brainline (subject to the terms of the agreement contained in this document) thereby enabling me to seek an alternative service provider, as I understand that Brainline acts as an independent service provider. I understand that I am under no obligation to use its services, nor is Brainline under any liability, on such termination, to render any assistance to me or the learner(s).
6. I understand that Brainline is an independent service provider, registered with the IEB (Independent Examination Board) and as such is bound to and respectful of the regulations of the IEB. I further understand that the relationship between myself and/or the learner (as client/s) and Brainline, is not within the jurisdiction of the IEB. All communication regarding the client-service provider relationship and/or offerings will be between myself and Brainline, and not the IEB.
7. As the client, I hereby authorise either yourselves or a transporter, the choice of whom shall be at your absolute discretion, to deliver the product (or part thereof) as an electronic download or online to the primary contact details of the parent/guardian, as well as the learner, as per the details I supplied via the enrolment platform (mybrainline.com).
8. If any product (or part thereof), purchased in terms of this agreement, are faulty, I understand that such products shall be replaced free of charge, on condition that I notify you thereof within five business days of receipt of the product by way of an email to [email protected]. This includes ensuring that full access to all enrolled subjects is available to the learner on brainONLINE within 48 hours of enrolment.
9. I recognise that, upon registration, the Brainline learner will receive a dedicated student email address (S*****@brainline.com) where all brainONLINE notifications will be sent. These brainONLINE notifications will also be sent to the parent/guardian email address supplied by me and kept current by myself on the enrolment platform upon enrolment.
10. I recognise that the bulk of my communication with Brainline is done telephonically, via email, brainONLINE, and the enrolment platform. For this reason, I accept the importance of supplying Brainline with my complete and correct electronic contact information: dedicated parent/ guardian and learner email address, as well as cell phone number and alternative contact details.
11. I acknowledge that the email addresses registered on the parent/guardian profile will be the recipient address of messages form brainONLINE regarding all important academic matters.
12. I understand that Brainline's communication with me is done through email. I understand that non-receipt of email from Brainline cannot be alleged, as the management of my email account is my own responsibility. Brainline cannot be held accountable for my failure to open and read my emails, or for loss of access to my emails. This may include 0 marks awarded for missed assessments.
13. I recognise that it is my responsibility to ensure that my enrolment information on the enrolment platform is correct and updated at all times. This includes my residential and/or postal address, email address, or telephone numbers. I agree that I shall bear all costs that Brainline may incur because of my failure to update my enrolment information.
14. I declare that I am aware of the nature, quality and content of your product. I accept the product as it is, with no warranties whatsoever and that any disputes will be handled under Section J of this agreement.
15. I am aware that all delivery costs, for whatever reason, including any shipping costs, postage, freight, handling charges, and costs of media, will be for my account.
16. All software and learning material enclosed has not been sold but rather licensed to me for use only under the terms of this agreement. I am aware that Brainline reserves all rights not explicitly granted to me. Unless otherwise stated, Brainline retains all title and ownership of its immaterial goods and related documentation. Only the learners enrolled with Brainline may use Brainline's software and learning material. All electronic and hardcopy submissions become the property of Brainline.
17. In the event of a problem experienced of any nature whatsoever, I bear knowledge of Brainline's telephone numbers, and email address, where I may contact you for client service. I understand that a problem experienced by me, of any nature whatsoever, does not entitle me to cancel this agreement or cease payments. I also take cognisance of the following support contact details:

18. I accept that a certificate signed by a Brainline-authorised official is sufficient proof of details stated herein for the purpose of obtaining any provisional summons or other sentence against me, or for any other purpose. Such a certificate shall also serve as prima facie proof that the stated amount, together with interest, is owed by me, and that the interest is payable at the rate stated therein.
19. I provide the information on the enrolment platform for the purpose of obtaining my credit record, and I understand that Brainline may investigate my credit record and report information concerning my credit conduct about my Brainline account to credit bureaus and others.
20. I understand that non-payment of my account will lead to suspension of services and access to brainONLINE for myself and/or the learner(s). I recognise that it is my responsibility to submit sufficient proof of payment of my account.
21. I understand that suspension of all services to me (and therefore the learner) will result in the unavailability of all forms of assessments. I understand that this will lead to loss of marks as no alternative assessments will be offered. I herewith irrevocably accept full responsibility should such a situation occur, as Brainline is not subsidised by the Department of Education and non-payment on my part is a breach of contract. This will result in the learner(s) being disadvantaged, due to my own negligence. I, therefore, indemnify Brainline as well as its staff against all responsibility in this regard. I understand that, where any form of assessment was missed because of suspension of my services, an additional fee for the setting and marking of these assessments will be for my own account.
22. I understand that Brainline is an independent, privately owned online school and service provider.
22.1 As such, although subject to all policies and procedures of both the IEB and Umalusi, Brainline acts with integrity and of its own accord in all matters pertaining to the running of this legal entity in line with its own values of reliability, consistency, and validity in a moral and ethical way while employing sound educational practices.
22.2 This implies that all complaints and queries need to be directed to Brainline itself until all avenues or recourse have been exhausted.
23. I shall not reproduce, copy, or cause to be copied, any part of Brainline's product. I agree to a penalty to the amount of at least R100 000 (one hundred thousand rand) if found guilty of such a transgression. This penalty amount does not include any legal fees incurred by Brainline, but which will be payable by me if I am found guilty. The amount may increase depending on the evidence put forward by Brainline.
24. I understand that Brainline reserves the right to investigate any instances where original academic reports, and or any other information has been fraudulently altered. I agree to a penalty if found guilty of such a transgression, which may be determined by legal parties conducting the investigation. This penalty amount does not include any legal fees incurred by Brainline, but which will be payable my me if found guilty. The amount may increase depending on the evidence put forward by Brainline.
25. I understand that the education of my child/children is my own responsibility and not the responsibility of Brainline, which I understand is merely providing an educational aid.
26. I understand that Brainline does not alter the curriculum as indicated by the National Department of Basic Education (as per the Revised National Curriculum Statement), as no one other than the aforementioned department and the IEB (Independent Examinations Board) is authorised to do so. However, it is the right of the parent(s) to edit the curriculum according to their own beliefs. Parents/educators/guardians should do this cognisant of possible ramifications for assessment.
27. I accept personal responsibility for ensuring that all subject choices are in line with the careers envisaged for learners in grades 10 to 12.
28. I acknowledge that I/my child, as a student enrolled to write the Grade 12 IEB NSC examination, will be deregistered from the IEB NSC examination for any subject for which I/he/she do(es) not comply with the compulsory SBA requirements as set by the IEB. I understand that this means that no NSC examinations will be written in said subject(s), effecting an incomplete subject set and no issuance of a Grade 12 certificate. The outstanding subject(s) will need to be repeated in full and at my own cost in the following academic year.
29. I shall be liable for all the costs in the event of legal action arising from the breach of this agreement, these being on the attorney-client scale plus collection commission.
30. I agree to the jurisdiction of the Magistrate's Court for all legal proceedings on breach of this agreement.
31. I understand that enrolment with Brainline does not constitute any form of application/registration/enrolment with any other authority, either private or public, such as the Department of Education.
32. I understand that neither the marking guidelines for certain practical assessments, marked final examinations nor the corresponding marking guidelines for any phase or grade will be released. This applies to all grades, including Grade 12, BrainlineCOMPACT and Supplementary Examinations. The conditions under which a viewing of the aforementioned documents may be scheduled at a fee are set out in the Assessment Procedure/FAQ document on brainONLINE.
33. Brainline has the right and is entitled to, in its sole discretion and without providing reasons therefore, refuse my child/children admission, enrolment or yearly re-enrolment and/or re-admission to Brainline. Nothing in this Agreement should be interpreted as a representation or warranty made by Brainline that my child/children will be admitted to and enrolled with Brainline annually.
34. Should Brainline, in its sole discretion, determine that the relationship between Brainline and myself has broken down irretrievably, Brainline is entitled to unilaterally terminate this agreement by providing thirty (30) days' written notice thereof. I understand that, upon termination of this agreement in terms of this clause, Brainline is under no obligation to render any assistance or services to me or the learner. Brainline will reimburse me for the unexpired part of the year when I/my child will receive no further services from Brainline.

B. ASSESSMENT

1. I understand that the Brainline formal notification received when a student uploads an assignment means that the uploaded document has been received. However, the notification does not imply that the uploaded document has been checked by Brainline. The validity of the document (correct file, not corrupt, completeness, readability) will only be checked during the marking process, which will commence after the final submission date.
2. I understand that the initial uploaded document remains in draft mode until the student clicks the final submission button. While in draft mode, the file can be changed or swopped by the student. Once the final submission date has passed, the draft file will be deemed to be the final submitted version for marking and cannot be replaced.
3. It remains the student's responsibility to follow all the on-screen steps once the draft has been uploaded.

• Download the file that has been uploaded to the upload link on brainONLINE.

• Check that the file opens, that the correct Answer Book has been submitted and that all the relevant pages have been scanned included in the file and are clearly legible.

4. By clicking the final Submit button, the learner accepts that a zero mark will be awarded should the marker be unable to mark all or part of a submitted assessment for whatsoever reason, which includes corrupt files, files that do not open and incorrect uploads.
5. I understand that, should a learner leave the upload in draft format and fail to complete the required steps before the final Submit button is clicked, the same will apply to the draft file once the final submission date has passed.
6. I understand that all formal assessments are bound by the set timetables that can be downloaded from brainONLINE and cannot be written on any other date or time.

C. INVIGILATION

1. I acknowledge that I am required to have an invigilator for the learners in Grade 8 to 12. An invigilator must be an independent person, older than the age of 18 years, not related to the learner, possess good reading and comprehension skills and be computer literate. This person must complete and pass the required brainONLINE invigilator test.
2. A parent/learner may opt for the Brainline Online Invigilation Service for compulsory assessments, unless stated otherwise. I recognise that these fees are for my own account. I understand that it is my responsibility to attend/ensure that the learner attends in the case of compulsory proctoring sessions and failing to attend may result in a 0 mark.
3. I recognise that all invigilation fees are excluded from the standard Brainline product fees and that these fees are for my own account as quoted by Brainline upon request, sent to [email protected].
4. No person who is a direct family member of a learner/student who is writing the examination is suitable to be appointed as an invigilator for that student.
5. Additional invigilation fees are applicable in the following cases:
5.1 Where a parent/learner opts to make use of the Brainline Online Invigilation Service for assessments, including stated compulsory assessments.
5.2 In the case of the Grade 12 preliminary examination, which must be completed at a Brainline examination centre (if the public health situation regarding Covid-19 or otherwise permits) or via the Brainline Online Invigilation Service.
5.3 In the case of Grade 12 final examinations, where accommodation has been approved for a candidate by the IEB, additional fees will apply on an hourly basis. Where a candidate is granted separate venues, extra time and/or examinations on computer, the dedicated services of a single invigilator to each individual learner is a requirement of the IEB.
5.4 In the case of Grade 12 Life Orientation, the learner must take note of the fact that CAT Paper 2 is to be written at a Brainline Examination Centre (if the public health situation regarding Covid-19 or otherwise permits) or via the Brainline Online Invigilation Service as directed by Brainline.
5.5 In the case of Grade 12 Life Sciences, the three PAT sessions can only be completed at a Brainline examination centre. As far as possible, learners will be accommodated in the centre closest to their homes.
5.6 In the case of Grade 12 Consumer Studies, the practical component of the PAT can only be completed at the Brainline head office in Montana, Pretoria.
5.7 In the case of Grade 12 Dramatic Arts, the practical component of the PAT can only be completed at the Brainline head office in Montana, Pretoria.
5.8 In the case of Grade 12 Visual Arts, the learner must take note of the fact that final Visual Arts Paper 2 examination is to be completed at a Brainline Examination Centre as directed by Brainline.
5.9 When invigilation services at one of the Brainline branches or online invigilation services are required, additional costs will apply, as quoted by Brainline upon request, sent to [email protected].
6. I acknowledge that Brainline may alter the invigilation process at any time without consultation, based on requirements in the interest of transparency, validity and reliability. Parents, guardians and educators should keep the data related to such processes in a safe place for a period of at least three years. Such data should be easily accessible and readily available as and when required by the Department of Education, Brainline, the IEB and/or its subsidiaries.
7. I accept that invigilation requirements may include (but are not limited to) online invigilation, which may involve the recording of examination sessions on the secure site/server of a third party, self-made recordings on electronic devices, or any other invigilation procedures duly approved by the IEB. Such requirements may change at any time and must be strictly adhered to in the interest of safeguarding all assessment results as it pertains to the National Senior Certificate. Nonadherence to these requirements (where it applies to specific products) will lead to the suspension of my profile and/or that of the learners.
8. I acknowledge that Brainline, in the interest of safeguarding the validity and reliability of learner marks obtained for tasks, tests and examinations, reserves the right to award a zero mark for an assessment on suspicion that any of the invigilation process has been contravened. Such suspicion will be investigated by the Irregularities Committee and the outcome will be communicated to the parent(s) and/or learner.
9. I acknowledge that Brainline, in the interest of safeguarding the validity and reliability of learner marks obtained for tasks, tests and examinations, reserves the right to cancel a parent/learner profile on suspicion that any aspect of the invigilation process has been contravened. Cancellation of said account can be done without prior notice and may/may not be reinstated after investigation of such incidents. It remains the responsibility of the parent/guardian/learner to prove that invigilation procedures have been adhered to.
10. Brainline reserves the right to suspend the account of a parent/learner if such a parent/learner refuses to comply with the standard protocols within a defined product, as published not only in this document, but also (and not excluding) all documents and information on brainONLINE. Should a parent/educator/guardian refuse to adhere to such protocols, the profile will be cancelled. Pro rata refund of monies paid to Brainline will occur in accordance with the Brainline Cancellation and Refund Policy (see Section J).

D. OTHER FEES AND SUBJECT CONDITIONS

1. I acknowledge that the following may apply to my enrolment with Brainline as applicable per subject:
1.1 In the case of Physical Sciences: Taking Mathematics as subject is a prerequisite for taking Physical Sciences in Grade 10 to 12. Should a learner change from Mathematics to Mathematical Literacy at any stage, a compulsory subject change fee from Physical Sciences will be required as quoted by Brainline.
1.2 Practical examination fees in Grade 12 for the following subjects: Consumer Studies, Computer Applications Technology, Life Sciences, Visual Arts, and Dramatic Arts, as quoted by Brainline.
1.3 In the case of Grade 12 language subjects:
• Learners must attend a compulsory scheduled oral examination. This oral examination may be in the form of a Skype session, a Zoom session, in groups or a personal conversation between the examiner and the learner. The methodology of the oral examination (unless the learner has a specific accommodation) and the venue is at the discretion of the examiner and may not be changed.
• Every year, the IEB randomly selects learners who are enrolled for Languages (Home and/or FAL) for oral moderation. Learners who are selected for such an oral moderation session must attend it at the designated Brainline venue in person. This venue is determined by the IEB.
1.4 In the case of Consumer Studies: Learners must attend a compulsory three-day practical workshop at the Brainline head office in Montana, Pretoria. Additional fees for this practical workshop as quoted upon enrolment with Brainline, as well as travelling fees are for your own account.
1.5 In the case of Dramatic Arts: Learners must attend compulsory practical workshops, at the Brainline Montana branch. Additional fees for this practical workshop as quoted upon enrolment with Brainline, as well as travelling fees are for your own account.
1.6 In the case of Life Sciences: Learners must attend a compulsory two-day practical workshop and write the final IEB Practical Assessment Task at Brainline's Umhlanga, Stellenbosch or Montana branches. As far as possible, learners will be accommodated in the centre closest to their homes. Additional fees for this practical workshop and assessment as quoted upon enrolment with Brainline, as well as travelling fees are for the learner's own account.
1.7 In the case of Life Orientation: The learner must take note of the fact that CAT Paper 2 is to be written at a Brainline Examination Centre (if the public health situation regarding Covid-19 or otherwise permits) or via the Brainline Online Invigilation Service as directed by Brainline. Additional fees for this examination as quoted upon enrolment with Brainline, as well as travelling fees are for the learner's own account.
1.8 In the case of Grade 12 Visual Arts, the learner must take note of the fact that the final Visual Arts Paper 2 examination is to be completed at a Brainline Examination Centre as directed by Brainline. Additional fees for this examination as quoted upon enrolment with Brainline, as well as travelling fees are for the learner's own account.
1.9 In the case of Music:
• The learner must have access to a musical instrument.
• The learner must have completed at least Grade 2/3 Musical Theory to enrol for Music in Grade 10.
• The learner must have completed at least practical on a Grade 3 level.
• External practical music exams are for the learner's own account. 1.10 In the case of Equine Studies:
• The learner must have access to a horse on which to compete.
• The learner must have access to a Level 1 SANIP instructor for practical tasks.
• The learner must have the required horse-riding equipment.
• The learner must have access to and attend regular riding lessons.
• The learner must have competed in at least 4 competitions:
• Grade 11: Novice level
• Grade 12: Above novice level
1.11 In the case of Computer Applications Technology, the learner must have access to the following software, at their own cost:
• Microsoft Office 365 including MS Access
• Microsoft Windows 10
• Notepad++
1.12 In the case of Engineering Graphics and Design:
• The learner must have the required drawing instruments and an A3 printer and scanner.
• CAD is a compulsory in Grade 12.
1.13 In the case of BrainlineCOMPACT:
• Learners who wish to extend their BrainlineCOMPACT Phase 1 to Phase 2 in November, may do so at an additional fee as quoted by Brainline with a request sent to [email protected].
• A learner may not postpone their Phase 2 examinations to the next academic year. Should this be the case, they would have to re-enrol at the standard price for the BrainlineCOMPACT product for the following year as quoted upon enrolment for the following year.
1.14 Remarking, moderation of marked files, as well as viewing of said files will incur an additional charge as quoted by Brainline.

E. THIRD PARTY RELATIONSHIPS

1. I acknowledge that Brainline does not have any relationships or affiliations with any third parties, such as tutors, tutor centres, cottage schools, micro-schools, teachers, independent schools, public schools or any other educational institution, unless expressly stipulated in writing.
2. I understand that the product is supplied to parents or guardians of learners enrolled on the enrolment platform and, as such, will not communicate or entertain any conversations or agreements with any third party, as mentioned above, other than the parent/guardian orindividual.
3. I accept that Brainline will not be held responsible for any dispute between parents, guardians or individuals and any other third party.
4. I acknowledge that a third party will be held liable in terms of a copyright infringement where he/she acts on behalf of a parent, guardian or individual. A penalty as contained in clause A.23 may become applicable where such an infringement has occurred.
5. I accept that no third party may enrol any learner or individual with Brainline on behalf of a parent, guardian or individual, with or without their consent.
6. I acknowledge that the enrolment of a learner or individual is the express responsibility of the parent, guardian or individual.
7. I understand that a third party cannot accept payment on behalf of Brainline.

F. COPYRIGHT OF LEARNING MATERIAL OR OTHER PRODUCTS SUPPLIED BY ANY THIRD PARTY

1. I accept that the use of Brainline software, its contents, and all other learning material provided, is subject to license restrictions. By installing or using this software and its contents, I agree to be bound by the terms and conditions of this agreement, Brainline policies and procedures, as well as other guidelines published on brainline.com and brainONLINE throughout the year.
2. I understand and agree that only a learner who is enrolled with Brainline may use the Brainline product for his/her personal, non-commercial use and not for re-sale or re-distribution.
3. I acknowledge that the Brainline product requires stable internet access daily in order to access brainONLINE.
4. I understand that it is my responsibility to access brainONLINE on a daily basis to ensure that I receive the latest academic updates.
5. I understand and agree that I am not permitted concurrent access to the learning material on more than three devices at a time.
6. I am only allowed to print hard copies of learning material provided by Brainline for my own personal, non-commercial, academic use, and not for re-sale or re-distribution. I am not allowed to make additional copies of any learning material in any format or on any device whatsoever. No other person or third party may print hard copies of or save, in any format or on any device, learning material on my behalf. This includes printing at a private home or any institution or business. Transgression of this term is a breach of the licensing agreement and legal action may be taken. The penalty, as contained in clause A.23, may also become applicable.
7. I am aware that a third party will be held liable in terms of a copyright infringement when he/she prints out or copies any material on behalf of a learner. A penalty as contained in clause A.23 may become applicable where such an infringement has occurred. Should such a need arise, the parent, guardian or individual may utilise the option of purchasing the hard copy of the ebook.
8. I accept that any and all copyright notices or acknowledgement of any publisher or its licensors and/or other intellectual property rights that may appear in the digital publications, including all copyright, trademark and similar notices, apply.
9. Should Brainline detect a systematic pattern of abuse by me, legal action shall be taken as well as measures to prevent further abuse, including the suspension of my account.

G. TECHNICAL REQUIREMENTS

1. I understand that Brainline delivers its course material, including, but not limited to, ebooks, learner guides and teachers' guides, through a downloadable computer application called Snapplify (https://www.snapplify.com/).
The Snapplify reader can be installed and run on any laptop, personal computer (PC) or tablet that runs any of the below operating systems, while also meeting the minimum hardware requirements:
Minimum operating systems supported:
• Android 4.4
• iOS 12
• macOS 11.0 (Big Sur)
• Windows 10
• Chrome OS 50
Minimum device specifications supported:
• Dual-core processor
• At least 2 GB RAM
• At least 16 GB hard-disk space
2. I understand that it is my responsibility to install an anti-virus programme and malware protection application that is trusted and updated on my dedicated laptop/PC.
3. I understand that I need the following hardware to complete my online study programme through brainONLINE:
3.1 A personal computer: laptop / PC.
3.2 A stable internet connection is required to use the Brainline product. A minimum of 50 GB will be needed per month for any student enrolled from Grade 8 and higher, depending on overall internet usage.
3.3 The following network speeds, as recommended by Brainline:
•At least 10 MBps upload and 10 Mbps download speed (for one user), and up to 25 MBps for two or more concurrent users.
•However, 5 Mbps download, 1 Mbps upload will work sufficiently.
3.4 A minimum of 2 GB RAM, however 4 GB RAM is recommended.
3.5 A minimum of 16 GB free hard-drive space or, in other words, at least 10 GB storage space on my computer.
3.6 A printer and scanner.
•An A3 printer and scanner, in the case of a learner registered for Engineering Graphics and Design.
3.7 A microphone and webcam, if my computer does not already have such inclusions or a front-facing camera on a smartphone/tablet, required to enable me/my child to participate in online video discussion, oral assessments and the like.
4. I understand that Brainline provides technical support to clients with regard to brainONLINE. Such support is limited to enabling clients to use the Brainline platforms where necessary. Additional/other technical support may only be available upon request at an additional cost of a standard technician rate.

H. STUDY MATERIAL

1. I understand that Credobooks (https://www.credobooks.co.za/) is the preferred provider to Brainline learners for purchasing their prescribed study material in the form of hardcopies.
2. I understand that Credobooks is a third-party services provider that is independent from Brainline. All support in relation to the Credobooks service must therefore be directed to the Credobooks help desk. If you need any assistance, please send an email to [email protected].
3. I understand that Snapplify (https://www.snapplify.com/) is the preferred provider to Brainline learners for purchasing their prescribed study material in the form of ebooks. I understand that all ebooks supplied by Snapplify are not printable, except for the Brainline Grade 1 to 3 ebooks and the Brainline Mathematics Programme.
4. In understand that Snapplify is a third-party services provider that is independent from Brainline. All support in relation to the Snappliy website/application must therefore be directed to the Snapplify help desk. If you need any assistance, please send an email to [email protected].
5. The following are technical requirements for a parent/guardian/learner to be able to use the Snapplify application (these requirements are subject to change by Snapplify):
5.1 There is a limit to how many devices onto which a user can load their purchased content. This limit is set by the publisher of the book and usually ranges from two to five devices.
5.2 Minimum operating systems supported:
•Android 4.4
•iOS 12
•macOS 11.0 (Big Sur)
•Windows 10
•Chrome OS 50
5.3 Minimum device specifications supported:
•Dual-core processor
•At least 2GB RAM
•At least 16GB hard-disk space
6. I understand that I may opt to choose hardcopy books instead of digital books or together with digital books at an additional cost as quoted by the chosen study material provider.
7. I understand that it is my responsibility as parent/ guardian/ learner to purchase my own study material as prescribed by Brainline on the Brainline booklist from either Snapplify (digital books) or Credobooks (hardcopy books). The Brainline booklist may be found at https://brainline.com/booklist/ or on the chosen study material provider website.
8. I understand that some study material may not be available in digital format and is only available in a hard copy format, which may include some prescribed literature, that must be purchased on my own account.
9. I understand that Brainline cannot be held accountable for any study material bought incorrectly by myself as the parent/ guardian/ learner.
10. I understand that, as Brainline is neither the publisher nor the author of most of the prescribed study material, Brainline cannot be held responsible for any errors, except in the case of the Grade R to 3 Brainline books.
11. I understand that Brainline reserves the right to recommend a new provider of study material to their clients should such a selection of alternative provider be considered in the interest of its clients and learners.
12. I understand that if I cancel my enrolment with Brainline, it is my own responsibility to contact Snapplify to arrange transfer of the books form my Brainline email to my own personal designated email to ensure continued access to the study material.

I.PAYMENT POLICY AND ACCOUNTS INARREARS

I. Payment Policy

I acknowledge that the following payment methods are accepted:

1.1 Full payment of the total amount.
1.2 Initial non-refundable deposit equal to 20% of total course fee payable via EFT, credit or debit card or direct cash deposit, followed by debit order payments subject to a qualifying credit rating and submission of the mandatory Debit Order Mandate and supporting documentation as per the Debit Order Mandate.
1.3 Debit order processing dates are on the 1st, 15th and 25th of a month. Should the 1st, 15th or 25th day of the month fall on a weekend or public holiday, the debit order will be processed on the previous business day.
2. I acknowledge that Brainline does not accept cash payments at its respective branches.
3. I accept that Brainline does not accept monthly instalments via EFT, credit or debit cards, and RECOGNISE THAT ONLY DEBIT ORDER PAYMENTS ARE ACCEPTED.
4. I accept that debit order payments are expected on a month-to-month basis to ensure continuous service, starting from the date on which Brainline accepts the enrolment, subject to academic and financial approval.
5. I accept that I may pay for the product in instalments, ON THE CONDITION THAT the full outstanding amount (inclusive of the final instalment payment) must be made before 30 November 2022.
6. I am liable for payment of a penalty fee of R250 if my debit order payment fails, and a subsequent payment is not made within the next two business days.
7. I undertake to settle my account in full before re-enrolling forthe following year,should I decide to do so. I understand that I will not be able to re-enrol for the following year until my account is settled in full.


 

II. Accounts in arrears

8. When my account is in arrears, it will be dealt with in the following manner:
8.1 If my account is in arrears, Brainline will notify me regarding the default in payment by SMS and/or email and/or telephone call.
8.2 Failing payment of my account, Brainline will suspend services within two business days from receipt of notice of default. I understand that this will give rise to the implications as set out in clause A.20 and A.21. above. In addition to this, I fully understand that suspension of these services may cause the learner not to be able to write any applicable examinations as at that time. I accept full responsibility for this as well as the fact that such an examination cannot be rescheduled. In case of the latter (should the learner qualify), he/she may enrol for a supplementary examination (as available) at an additional fee.
8.3 I understand that Brainline reserves the right to hand me over to a debt collection agency, should I fail to pay my account. Continued non-payment amounts to a material breach that will result in the termination of my contract with Brainline.
9. I shall be liable for all costs in the event of legal action arising from the breach of this agreement, these being on the attorney-client scale plus collection commission.
10. I understand that I have to settle my account with the debt collection agency in full. Should I wish to re-enrol, I understand that the full amount for the applicable Brainline product must be paid in its entirety in order for the service to recommence.
11. Once I have been handed over to a debt collection agency, I will in future not be eligible for instalment payments with Brainline. Full payment of the total amount will be required

J. CANCELLATION AND REFUND POLICY

Definition(s):

• “Business days“ are all days excluding Saturdays, Sundays and public holidays.
• “Date of cancellation“ is the date on which a completed Cancellation Form was received by Brainline or, if not submitted on a business day, the first business day thereafter.
• “Product“ includes all goods and services, i.e. the curriculum purchased upon enrolment and any alterations/additions made to the enrolment during the year.
• “Prescribed cancellation period“ is at least 10 business days from the receipt of notice, prior to the commencement of the assessment/examination period or the following month, as indicated within the applicable clause(s).

I. General cancellation and refund procedure:

1. If I wish to cancel my contract and enrolment with Brainline, a cancellation request must be completed at https://www.brainline.com/cancellations/.
2. Cancellation requests will be processed within five business days from the date of receipt.
3. I remain liable to Brainline for the amount as agreed upon at the time of enrolment, up to the date of cancellation, including any other amounts as defined by each product's specific cancellation requirements. Brainline reserves the right to impose a reasonable cancellation penalty with respect to any goods supplied or services provided to me regarding this agreement.
4. A month's notice is required when requesting to cancel my enrolment with Brainline. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
5. If a cancellation request is submitted within five business days of enrolment approval, and it can be proven with sufficient audit evidence that no content was accessed, a refund will be calculated accordingly. Brainline reserves the right to impose a reasonable cancellation penalty with respect to any goods supplied or services provided to me regarding this agreement.
6. A cancellation of an assessment or examination submitted after the prescribed cancellation period is not eligible for a refund.
7. I understand that each Brainline product has specific cancellation requirements that must be adhered to.
8. The IEB examination fees for a Grade 12 student is immediately payable upon enrolment and is not eligible for a refund, unless a cancellation request is completed before or on 15 February 2022.

II.Brainline Grade R and School Readiness Test:

9. Grade R:
9.1 A non-refundable registration fee is paid upon enrolment.
9.2 A month's notice is required when requesting to cancel my enrolment of online activities and classes. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
9.3 Where the account for the entire academic year was settled in advance, the refund amount will be calculated based on the date of receipt of the cancellation request relative to the month of the year and content delivered. Brainline is entitled to charge a reasonable cancellation penalty.
10. School Readiness Test:
10.1 The complete school readiness test package is delivered upon enrolment. Cancellations received will therefore not be eligible for a refund.

III. Brainline Edu-123-Go! for Grade 1-3 and Optional Formal Examination:

11. A non-refundable registration fee is paid upon enrolment.
12. A month's notice is required when requesting to cancel my enrolment of online activities and classes. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
13. Where the account for the entire academic year was settled in advance, the refund amount will be calculated based on the date of receipt of the cancellation request relative to the month of the year and content delivered. Brainline is entitled to charge a reasonable cancellation penalty.
14. Optional Formal Examination:
14.1 A cancellation request for the June/November Optional Formal Examination must be submitted within the prescribed cancellation period.
14.2 A full refund will be provided if a cancellation request is submitted within the prescribed cancellation period.
14.3 Cancellations requests received after the prescribed cancellation period will not be eligible for a refund.

IV. BrainlineEXPRESS for Grade 4-11 and Optional Formal Examination:

15. The complete continuous assessment portfolio is delivered upon enrolment, which includes the minimum assessment items for the entire academic year except the Optional Formal Examination. The account holder is responsible for full settlement of the account upon enrolment. This product is not eligible for a refund upon cancellation.
16. Optional Formal Examination:
16.1 A cancellation request for the formal examination must be submitted within the prescribed cancellation period.
16.2 A full refund of the formal examination fee will be provided if a cancellation request is submitted within the prescribed cancellation period.
16.3 Cancellations received after the prescribed cancellation period will not be eligible for a refund.

V. Supplementary examinations for Grade 10 and 11:

17. The account holder is responsible for full settlement of the account upon enrolment.
18. A cancellation request must be submitted within the prescribed cancellation period to be eligible for a refund.Brainline reserves the right to impose a reasonable cancellation penalty.

VI. CAPS/IEB-aligned Brainline 4-7, IEB-aligned for Grade 8-11, and Single Subject enrolments:

19. A non-refundable deposit is paid upon enrolment.
20. A month's notice is required when requesting to cancel my enrolment. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
21. Where the account for the entire academic year was settled in advance, the refund amount will be calculated based on the date of receipt of the cancellation request relative to the month of the year and content delivered. Brainline is entitled to charge a reasonable cancellation penalty.

VII. Brainline IEB-aligned for Grade 12:

22. A non-refundable deposit is paid upon enrolment.
23. The IEB registration fee is immediately due to the IEB after registration of a matriculant and, therefore, not eligible for refund if a cancellation is submitted after 15 February 2022. Should my enrolment for the IEB NSC examination in any subject be cancelled by Brainline due to non-compliance with the SBA requirements, the IEB examination fee will not be refunded.
24. A month's notice is required when requesting to cancel my enrolment. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
25. Where the account for the entire academic year was settled in advance, the refund amount will be calculated based on the date of receipt of the cancellation request relative to the academic cycle and content delivered. Brainline is entitled to charge a reasonable cancellation.
26. No refunds will be processed for any Grade 12 cancellations received after 30 June 2022.
27. Compulsory fees for the Consumer Studies, Life Sciences and Computer Applications Technology practical examinations (if applicable):
27.1 A cancellation of enrolment that involves the aforementioned compulsory fees may be submitted before 30 June 2022.
27.2 A full refund will be provided if a cancellation request is submitted before 30 June 2022.
27.3 Cancellations received after 30 June 2022 will not be refunded.

VIII.BrainlineCOMPACT:

28. A non-refundable deposit is paid upon enrolment.
29. A month's notice is required when requesting to cancel my enrolment. I understand that I am liable to pay the required monthly fee during the afore-mentioned notice period.
30. Where the account for the entire academic year was settled in advance, the refund amount will be calculated based on the date of receipt of the cancellation request relative to the academic cycle and content delivered. Brainline is entitled to charge a reasonable cancellation penalty.
31. Learners who wish to extend their BrainlineCOMPACT Phase 1 to Phase 2 in November, may do so at an additional fee as quoted by Brainline with a request sent to [email protected]. This request must be submitted within the prescribed cancellation period before commencement of the Phase 1 examinations.
32. A learner may not postpone their Phase 2 examinations to the next academic year. Should this be the case, they would have to re-enrol at the standard price for the BrainlineCOMPACT product for the following year as quoted upon enrolment for the following year.
33. The BrainlineCOMPACT course (Phase 1 and Phase 2), once successfully completed, is followed by enrolment for the Grade 12 IEB aligned product after which the NSC (National Senior Certificate) will be obtained.
33.1 The policy as stated in point 7 (VII) “Brainline IEB-aligned for Grade 12” above is applicable.
33.2 The account holder is responsible for full settlement of the first year's account (Grade 10 and Grade 11) before the enrolment for Grade 12 will be permitted.

IX. Brainline Report2Go:

34. A cancellation request for the final examination must be submitted within the prescribed cancellation period.
35. A full refund of the final examination fee will be provided if a cancellation request is submitted within the prescribed cancellation period. Brainline is entitled to charge a reasonable cancellation penalty.
36. Cancellations received after the prescribed cancellation period will not be eligible for a refund.

K. ENTIRE CONTRACT

This agreement constitutes the entire agreement held between myself and Brainline. Any modifications shall be agreed to in writing and signed by the parties involved. This agreement novates any previous understandings or agreements between the parties. The parties waive the right to rely on any alleged provision not expressly contained in this agreement.
